Former Justice Minister Park Sung-jae denied all charges at his trial over allegations that he played a key role in an insurrection during former President Yoon Suk Yeol's botched martial law bid in 2024. The first hearing at the Seoul Central District Court followed his indictment by a special counsel last month over an alleged role in Yoon's declaration of martial law on December 3, 2024.
Park's defense said, "At the time of the martial law declaration, the defendant actively opposed it as a member of the Cabinet. Ultimately, he failed to dissuade Yoon, and he feels profound remorse toward the people and a sense of deep shame for causing confusion to the constitutional order." They argued Park was unaware of Yoon's plan and discussed his role as a minister to prevent confusion under martial law, rejecting the claim that he supported the declaration.
Park is accused of actively participating in Yoon's imposition of martial law by convening a meeting of senior ministry officials, ordering the possible dispatch of prosecutors to a martial law-related organ, among other allegations.
The defense also denied allegations that the former minister violated a law prohibiting improper solicitation by acting on a request from Yoon's wife, Kim Keon Hee, to help clear her of various criminal charges.
The hearing followed a request by the special counsel to seek the death penalty for Yoon earlier this month on charges of leading an insurrection through his failed martial law attempt. A verdict in that trial is expected on February 19.

박의 측 변호인단은 지난해 12월 3일 윤 전 대통령의 계엄령 선언과 관련해 그를 기소한 특별검사 조은숙의 기소 이후 서울중앙지법에서 열린 첫 공판에서 주장을 제시했다.
박 변호인은 "계엄령 선포 당시 피고는 내각의 구성원으로서 이를 적극적으로 반대했다"며 "결국 윤 전 대통령을 설득하지 못했고, 헌법 질서에 혼란을 초래한 것에 대해 국민에게 깊은 반성과 큰 수치심을 느낀다"라고 밝혔다.
박 측은 박이 윤 전 대통령의 계엄령 계획을 알지 못했고 계엄 하의 혼란을 막기 위한 차원의 논의에 한정됐으며, 특별검사가 주장한 계엄 선언 지지 주장을 반박했다.
박은 고위 부처 관계자 회의를 소집하고 계엄 관련 기관으로의 검사 파견 가능성을 지시하는 등 윤 전 대통령의 계엄령 시행에 적극적으로 관여했다는 혐의를 받고 있다.
박의 변호인은 또한 윤 전 대통령의 부인 김건희의 요청에 따라 그녀의 각종 형사 혐의를 벗기려 한 행위가 "부정청탁 금지에 관한 법률" 위반 의혹이라는 주장을 부인했다.
이번 공판은 특별검사단이 이달 초 윤 전 대통령이 실패한 계엄 시도를 통해 반란을 주도했다는 혐의로 사형을 요구한 직후 열렸다. 그 재판의 판결은 2월 19일 선고될 예정이다.
