Acting President Han Duck-soo vetoed a bill on Tuesday that sought to limit his powers regarding the appointment of justices to the Constitutional Court. This decision was made during a Cabinet meeting, where a motion for parliamentary reconsideration of the proposed revision to the Constitutional Court Act was approved.
The motion will be sent back to the National Assembly for a revote. Han expressed concerns about the amendment, stating that it conflicts with the constitutional governance structure and the separation of powers. He emphasized that Article 71 of the Constitution allows the prime minister to exercise presidential powers by proxy when the president is unable to fulfill their duties, without imposing additional restrictions on the acting president's responsibilities.
Korea is currently without an elected leader following the impeachment of former President Yoon Suk Yeol on April 4. The amendment to the Constitutional Court Act was initially passed by the National Assembly on April 17, supported by the liberal Democratic Party.

한덕수는 회의 중 "제안된 개정안은 헌법에서 규정한 기본적인 정부 구조와 권력 분립에 관한 중요한 사항들을 법으로 명시하고 있으며, 현재 헌법 규정과 상충하는 내용을 담고 있다"고 말했다. 이어서 "헌법 제71조는 대통령이 직무를 수행할 수 없을 때 국무총리가 대통령의 권한을 대행하도록 규정하고 있으며, 권한대행의 직무 범위에 대해 별도의 제한을 두고 있지 않다"고 덧붙였다.
현재 한국은 4월 4일 윤석열 전 대통령의 탄핵 이후 선출된 지도자가 없는 상태이다. 헌법재판소법 개정안은 4월 17일 국회를 통과하였다.
