A court has sentenced retired Army Maj. Gen. Noh Sang-won to two years in prison for collecting personal information of military intelligence officers related to last year's martial law.
The Seoul Central District Court also ordered Noh to forfeit 24.9 million won (approximately $17,000) for accepting bribes from subordinate officers.
This ruling marks the first court sentence in cases being investigated by special counsel Cho Eun-suk's team concerning former President Yoon Suk Yeol's martial law imposition on December 3 of last year. In a previous hearing, the prosecution had sought a three-year sentence for Noh.
Noh was indicted for acquiring military intelligence, including personal details of Defense Intelligence Command (DIC) agents, from military commanders between September and December last year. This was reportedly to establish an organization aimed at investigating allegations of election fraud.
Furthermore, he faced charges for accepting 20 million won in cash and department store gift certificates valued at 6 million won from a brigadier general and a colonel in exchange for aiding in their promotions.
The court emphasized that Noh's actions were significant contributors to the declaration of martial law.
Noh was identified as a close associate of former Defense Minister Kim Yong-hyun, who has been arrested for his role in the martial law declaration.
서울중앙지법은 12월 8일 퇴역 육군 소장 노상원을 군사정보 장교의 개인 정보를 수집한 혐의로 2년형에 처했다고 밝혔다.
노 전 DIC(국방정보본부) 사령관은 하급 장교로부터 뇌물을 받은 혐의로 2천490만 원(약 1만7천 달러)을 몰수당하기도 했다.
이 사건은 작년 12월 3일 전 대통령 윤석열의 계엄령 선포 관련 혐의를 조사하는 특별검사 조은석 팀이 처리한 사건 중 첫 번째로 법적 판결이 내려진 사례이다. 조 팀은 지난 심리에서 노 씨에게 3년형을 구형했다.
노 씨는 지난해 9월부터 12월 사이에 군 지휘관들로부터 DIC 요원의 개인 정보를 포함한 군사정보를 수수하면서 선거 사기 혐의 조사를 위한 조직을 구축할 목적으로 정보를 받은 혐의로 기소됐다.
또한 그는 지난해 8월부터 9월 사이에 준장과 대령으로부터 승진을 도와주겠다는 약속의 대가로 2천만 원의 현금과 총 600만 원 상당의 백화점 상품권을 수수한 혐의도 있다.
법원은 노 씨의 범죄가 계엄령 선포로 이어지는 강력한 요인 중 하나였기 때문에 책임이 있다고 판시했다.
노 씨는 윤 대통령의 계엄령 선포에 연루되어 구속된 전 국방부 장관 김용현의 측근으로 알려져 있다.
